General Terms and Conditions of Sale (GTC) – SAWATELL
1. Purpose
These General Terms and Conditions of Sale (hereinafter "GTC") govern the sale of products on the website www.sawatell.shop by the company SAWATELL SARL to consumers within the meaning of the French Consumer Code (Code de la consommation). Any order placed implies the unreserved acceptance of these GTC.
2. Products
The website offers for sale, without limitation, products related to home automation, the IoT (Internet of Things), and high-tech technologies, hereinafter referred to as the "Products." Photographs and illustrations of the Products are non-contractual. SAWATELL undertakes to supply Products that comply with the legislation in force in France and the European Union.
3. Prices
Prices are indicated in euros, all taxes included (TTC), excluding delivery charges. Delivery charges are specified before the final validation of the order. SAWATELL reserves the right to modify its prices at any time; however, Products are invoiced on the basis of the rates in force at the time of order validation.
4. Orders
The ordering process includes the following steps:
Selection of Products and adding them to the cart;
Review of the cart (quantities, prices, delivery);
Entry of billing and delivery information;
Choice of payment method and order validation.
SAWATELL reserves the right to refuse any order in the event of an existing dispute with the Customer or suspicion of fraud.
5. Order Confirmation
Once the payment is validated, the Customer receives a confirmation email summarizing the essential details of the order. The sale is considered final after this email has been sent.
6. Payment
Accepted payment methods include, but are not limited to: credit/debit cards, PayPal, and bank transfers. Payment is due immediately upon ordering. Transactions are secured via an SSL encryption protocol. SAWATELL does not have access to the Customer's banking data at any time.
7. Delivery
Delivery Zones: SAWATELL delivers to mainland France and selected European countries. For any other destination, the Customer is invited to contact SAWATELL before ordering.
Delivery Times: Orders are processed within 1 to 2 business days and delivered no later than 30 days from order validation.
Charges: Delivery charges are calculated during order validation based on the destination and weight of the Products.
8. Right of Withdrawal The Customer has a period of fourteen (14) days from the receipt of their order to exercise their right of withdrawal. (See Refund Policy).
Procedures: To exercise this right, the Customer must notify their decision by email to: sales@sawatell.com.
Product Condition: The Product must be returned in its original condition, unused, and in its original packaging.
Return Shipping Fees: Return shipping costs are the responsibility of the Customer, except in the case of a defective or non-compliant Product, or a delivery error attributable to SAWATELL.
Refunds: Refunds are processed within a maximum of 14 days after receipt and verification of the returned Product, using the same payment method as the one used for the order.
9. Legal Warranties
Legal Warranty of Conformity: The Customer has a period of two (2) years from delivery to take action. They may choose between the repair or replacement of the Product, subject to legal conditions. The Customer is exempt from proving the existence of the lack of conformity for 24 months, or 6 months for refurbished products.
Warranty Against Hidden Defects: The Customer may take action within a period of two (2) years from the discovery of the defect and choose between:
The cancellation of the sale;
Or a reduction in price.
10. Liability
SAWATELL shall not be held liable for indirect damages resulting from the use of the Products. This limitation does not apply to obligations relating to the legal warranty of conformity and the warranty against hidden defects.
11. Exclusions of Liability
SAWATELL cannot be held liable in the event of:
Non-compliance with the legislation of the delivery country;
Misuse, negligence, or lack of maintenance of the Product;
Normal wear and tear;
Force majeure.
12. Product Compatibility
Compatibilities are specified exclusively on the product data sheet. The absence of mention of a device, brand, or model implies a lack of compatibility. It is the Customer's responsibility to verify compatibility before placing any order. No implicit compatibility shall be assumed.
13. Included Batteries
Certain batteries supplied by the manufacturer are intended solely for testing or initial commissioning. They are provided for informational purposes and are not guaranteed regarding their charge level or lifespan.
14. Governing Law – Disputes
These GTC are governed by French law. In the event of a dispute, the Customer may submit a complaint to sales@sawatell.com. In the absence of an amicable resolution, the French courts shall have exclusive jurisdiction.
15. Extended Producer Responsibility – Electrical and Electronic Equipment (EEE) Sector
The unique identifier FR476328_05KHAH, certifying registration in the register of producers for the Electrical and Electronic Equipment (EEE) sector pursuant to Article L.541-10-13 of the French Environment Code, has been assigned by ADEME to the company SAWATELL SARL (SIRET: 97952492300013). This identifier certifies compliance with its obligation to register in the register of EEE producers and the completion of its market placement declarations with ecosystem.
